A corresponding purchase agreement had been signed in December 2006. The agreed purchase price for a stake of 25.1 percent was EUR 250 million. The agree-ment was subject to customary conditions, in particular antitrust and regulatory conditions.
In April 2007, the Polish antitrust authority rejected the application for approval for formal reasons.
Since the rejection by the antitrust authority, owner and buyer had explored various options for a legally secure and economically acceptable solution. The contracting parties regret that, despite efforts on both sides, they were unable to agree on an arrangement convincing to both sides.
